Welcome to Studio Wand! These Terms & Conditions ("Terms") govern your access to and use of our website, platform, and services. Please read them carefully before using the Service.
By clicking "I Agree," registering for an account, or otherwise accessing or using Studio Wand ("the Service"), you agree to be bound by these Terms. If you are entering into these Terms on behalf of a studio, company, or other legal entity, you represent that you have the authority to bind such entity. If you do not agree to these Terms, you may not use the Service.
Studio Wand provides a cloud-based studio management platform for class scheduling, student enrollment, attendance tracking, event management, membership billing, and related administrative tools. The Service is provided on a subscription basis.
You must provide accurate, current, and complete information when creating an account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach of your account.
Subscriptions: The Service is billed on a recurring subscription basis (monthly or annually). By signing up, you authorize Studio Wand to automatically charge your selected payment method for the applicable fees.
Free Trials: If you sign up for a free trial, you will not be charged until the trial period expires. To avoid being charged, you must cancel before the end of the trial period.
Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing cycle.
STRICT NO-REFUND POLICY: EXCEPT AS EXPRESSLY REQUIRED BY APPLICABLE LAW, ALL FEES PAID TO STUDIO WAND ARE NON-REFUNDABLE AND NON-CREDITABLE. Studio Wand does not offer refunds or credits for any partial subscription periods, unused accounts, or service interruptions.
You retain all right, title, and interest in and to the data and content you input into the Service ("User Content"), including student records and schedules.
Consents: You represent and warrant that you have obtained all necessary consents, permissions, and rights from your students (or their legal guardians if they are minors) to input their personal data into the Service.
Data Processing: Studio Wand acts as a Data Processor, and you remain the Data Controller of your student data.
Usage License: You grant Studio Wand a limited license to host, copy, transmit, and display your User Content solely as necessary to provide and improve the Service. We do not sell your data to third parties.
You agree not to use the Service for any unlawful purpose. You shall not:
We strive to maintain high availability, but we do not guarantee that access to the Service will be uninterrupted or error-free. We may occasionally perform maintenance or updates that temporarily affect the Service. We will endeavor to provide reasonable notice of planned downtime when possible.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STUDIO WAND, ITS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL STUDIO WAND'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE TOTAL AMOUNT PAID BY YOU TO STUDIO WAND IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
You agree to defend, indemnify, and hold harmless Studio Wand and its employees, contractors, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; or (c) any claim that your User Content caused damage or violated the privacy of a third party.
Either party may terminate this agreement at any time. Upon termination, your right to use the Service will immediately cease.
Data Export:It is your sole responsibility to export your data using the platform's standard export tools prior to the effective date of termination.
Data Retention: We will retain your data for thirty (30) days after termination, after which it may be permanently and irrevocably deleted from our systems.
Right to Data Purge: You have the right to request the immediate and permanent deletion of all your data at any time after account cancellation. To exercise this right, contact our support team. Once a data purge is initiated, all account data — including studios, classes, student records, enrollment history, transaction records, and any other associated data — will be permanently and irrevocably deleted from our active systems. This action cannot be undone.
Neither party shall be liable for any failure or delay in performance under these Terms (other than payment obligations) due to circumstances beyond its reasonable control. This includes, but is not limited to, acts of God, war, terrorism, strikes, supply chain failures, internet service provider failures, cloud infrastructure outages or delays, cyberattacks, power grid failures, or governmental actions.
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.
Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms shall be determined by binding arbitration in Monmouth County, New Jersey.
CLASS ACTION WAIVER: YOU AND STUDIO WAND AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
We reserve the right to modify or replace these Terms at any time. We will notify you of material changes via email or by posting a clear notice within the Service. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
